How LTB notice periods and service work

Deemed service. A notice counts as given the day it is handed over, left in the mailbox or under the door, faxed, or emailed (email only with written consent). Mail is deemed given on the 5th day after mailing (RTA s. 191(3)); courier the day after it is sent (next non-holiday day). We add those days before counting.

Notice periods (RTA): N4 non-payment — termination date not earlier than the 7th day after the notice is given, for notices given on or after Sept 21, 2026 (previously 14 days, or 7 for daily/weekly tenancies); N5 damage — 20 days with a 7-day chance to repair or pay (second N5 within 6 months: 14 days); N6 illegal act — 10 days (drug production/trafficking) or 20 days; N8 persistent late and N9 tenant’s notice — 60 days (28 for daily/weekly tenancies) ending on the last day of a rental period or the fixed-term end; N12 own use — 60 days to the end of a period/term, with one month’s rent compensation unless (from Sept 21, 2026) the landlord gives at least 120 days for landlord/family use; N13 — 120 days to the end of a period/term; N1 rent increase — 90 days and 12 months since the last increase.

How many days is an N4 now?

For notices given on or after September 21, 2026, the termination date must be at least 7 days after the notice is given — for monthly and weekly tenancies alike. Add 5 days if you mail it.

When can a landlord file the L1?

Not before the day after the termination date in the N4 (RTA s. 74(1)). If the tenant pays the arrears plus any rent since due before the L1 is filed, the N4 is void.

Does an N12 always need one month’s compensation?

No longer always: a landlord/family own-use N12 given on or after Sept 21, 2026 with at least 120 days’ notice ending at a period/term end needs no compensation. Shorter notice, or a purchaser’s own use, still requires one month’s rent or another acceptable unit.

My lease is fixed-term — can I give an N9 for any day?

No. A tenant’s N9 must give at least 60 days and end on the last day of the fixed term (or of a rental period once month-to-month). Ending early needs the landlord’s agreement (N11).

What is the deadline for a T2, T6 or T1?

Within one year of the conduct (T2/T6, RTA s. 29(2)) or of the money being collected or retained (T1, s. 135(4)).
